Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using Omoicho ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. The service

Omoicho is an analog-style photography and memory-keeping app. It lets you take a limited roll of photos tied to a place, keep notes about your travels, and revisit those memories as they develop over time. Features and behavior may change as the app evolves.

2. Eligibility

You must be old enough to form a binding agreement and to use the app under the laws of your country (at least 13, or the higher minimum age where applicable). If you are a minor, you may use the app only with the involvement of a parent or guardian.

3. Your content

You own the photos, notes, and other content you create in the app ("Your Content"). We do not claim ownership of Your Content. Because Your Content is stored on your device and in your own Google Drive backup, you are responsible for it, including keeping your own copies. You are solely responsible for ensuring you have the right to photograph the subjects and places you capture.

4. Acceptable use

You agree not to use the app to break the law, to infringe the rights of others, to photograph people or places where you do not have the right to do so, or to interfere with the operation or security of the app. Please respect the privacy of others when taking and keeping photos.

5. Purchases

The app offers an optional one-time purchase to remove ads. Purchases are processed by Google Play and are subject to Google Play's terms. Except where required by law, purchases are non-refundable. The ad-removal entitlement is tied to your Google Play account.

6. Advertising

Unless you purchase ad removal, the app displays advertising provided by third parties. We are not responsible for the content of third-party ads or for the websites or offers they link to.

7. Third-party services

The app uses Google services, including Firebase Authentication, Google Drive, Google Play Billing, and Google AdMob. Your use of those services is also subject to their respective terms and policies. We are not responsible for third-party services.

8. Availability

We provide the app on an "as available" basis and may modify, suspend, or discontinue any part of it at any time. We do not guarantee that the app will always be available, uninterrupted, or error-free.

9. Disclaimer

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that memories, photos, or backups will never be lost, and you are responsible for keeping your own copies of important content.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, photos, or memories, arising out of or related to your use of the app.

11. Termination

You may stop using the app at any time by uninstalling it. We may suspend or end your access to the app if you violate these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be indicated by the effective date above. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules, and any dispute will be subject to the courts of Brazil, unless the mandatory consumer-protection law of your own place of residence grants you the right to bring proceedings elsewhere.
